RESOURCE USAGE

Customers may not excessively consume server resources in ways that negatively impact infrastructure stability.

We reserve the right to:

  • Limit excessive resource consumption
  • Suspend overloaded services
  • Require upgrades for high resource usage
  • Restrict abusive workloads

Unlimited plans are subject to fair usage limitations.

PAYMENTS & BILLING

All invoices must be paid before the due date.

Failure to pay may result in:

  • Account termination
  • Data deletion
  • Additional recovery fees

All payments are:

  • Non-refundable unless explicitly stated
  • Charged in USD
  • Subject to applicable taxes and fees

Chargebacks or payment disputes may result in immediate suspension of all services.

REFUND POLICY

The following are non-refundable:

SERVICE AVAILABILITY

We strive to maintain 99.9% uptime for network and hosting infrastructure.

However, service interruptions may occur due to:

  • Scheduled maintenance
  • Emergency maintenance
  • Hardware failures
  • Software failures
  • Cyberattacks
  • DDoS attacks
  • Upstream provider outages
  • Force majeure events

Service uptime is not guaranteed.

SLA (SERVICE LEVEL AGREEMENT)

If monthly uptime falls below 99.9%, customers may request service credits.

Service credits:

  • Are applied as account credit only
  • Are not redeemable for cash
  • Must be requested within 7 days of the incident

The SLA excludes:

  • Scheduled maintenance
  • Customer-caused outages
  • DDoS attacks

  • Force majeure events

BACKUPS

FOX ITS LIMITED may provide automated backup services for convenience purposes.

However:

  • Backup integrity is not guaranteed
  • Restoration success is not guaranteed
  • Customers remain fully responsible for maintaining independent backups

We are not liable for data loss under any circumstances.

MANAGED SUPPORT

We provide limited managed support for infrastructure-related matters.

Application-level management, custom software troubleshooting, development support, or advanced administration may not be included unless explicitly agreed in writing.

DOMAIN SERVICES

Domain registrations are processed through third-party registrars.

We are not responsible for:

  • Registry actions
  • Domain disputes
  • Transfer delays
  • WHOIS inaccuracies
  • Registrar downtime

Customers are responsible for ensuring accurate registration information.

KYC & FRAUD PREVENTION

FOX ITS LIMITED reserves the right to request identity verification for suspicious or high-risk orders.

Verification may include:

  • Government-issued identification
  • Address verification
  • Payment verification
  • Business registration documents

Failure to complete verification may result in cancellation or suspension.

SUSPENSION & TERMINATION

LIMITATION OF LIABILITY

To the maximum extent permitted by law, FOX ITS LIMITED shall not be liable for:

  • Indirect or consequential damages

Total liability shall not exceed the amount paid by the customer during the previous three (3) months.

INDEMNIFICATION

Customers agree to indemnify and hold harmless FOX ITS LIMITED from any claims, liabilities, losses, damages, costs, or legal expenses arising from:

  • Customer activities
  • Violations of these Terms
  • Illegal content
  • Abuse complaints
  • Intellectual property disputes

GOVERNING LAW

These Terms are governed by the laws of Ireland.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.

CHANGES TO TERMS

FOX ITS LIMITED reserves the right to modify these Terms at any time.

Continued use of Services constitutes acceptance of updated Terms.
